Separate the legal question from the insurance question
Probate determines legal rights and responsibilities; an insurance policy determines contractual coverage. The executor, administrator, trustee, heir or other responsible party may need to work with both legal counsel and the insurance provider.
Information an insurance review may require
- Current policy information and the deceased owner's name.
- Identity and authority of the person responsible for the property.
- Available estate, probate or title documentation requested by the insurer.
- Whether anyone currently lives in the house.
- Property condition, utilities, security and frequency of checks.
- Whether the house will be sold, occupied, rented or renovated.
If the inherited house is empty
Vacancy can become the immediate insurance issue while the estate is being settled. TDI advises consumers to ask how an insurer defines vacancy and whether claims will be paid on a house that remains vacant for an extended period.
| Likely next use | Insurance question to review |
|---|---|
| Empty during probate | Vacancy and estate-property eligibility. |
| Heir moves in | Owner-occupied coverage when ownership and occupancy support it. |
| Property becomes a rental | Landlord or dwelling coverage. |
| Renovated before sale or occupancy | Vacancy plus construction activity. |
Review coverage again when the estate's plan changes
An estate property can move from vacant to occupied, rental or sale. Each transition is a reason to update the insurer or agent.
For an inherited property, tell us two separate things: who is currently responsible for the property and what is physically happening at the house. Both can matter to the insurance review.

Is an inherited Texas house sitting empty?
Provide the current occupancy, condition, responsible party and intended use so available coverage can be reviewed.

Frequently asked questions
Does a homeowners policy automatically end when the owner dies?
Policy provisions vary. The responsible party should notify the insurer promptly and ask how the policy addresses death of an insured, legal representatives, ownership and occupancy.
Can a house in probate be insured while vacant?
Possibly. Eligibility depends on the property, ownership or estate documentation, condition, occupancy and provider underwriting.
Who should contact the insurer?
The executor, administrator, trustee, heir or other person with responsibility or authority for the property should contact the insurer and provide requested documentation.
What if an heir later moves into the house?
Coverage should be reviewed again because owner occupancy can call for a different policy approach than an empty estate property.
